By purchasing an advertising campaign from Ads-On-Q, either directly, or through an affiliate publisher, you do hereby confirm that you have read and agree to, the following terms of service:

Writing Services: AdsOnQ will custom create a promotional article for you, should you choose not to write for yourself. This is part of our service. Articles written for clients give copyright of the article to the client, with first distribution rights on the AdsOnQ's RSS feed.Your copy will be optimized for keywords and search engine spiders.



Ad copy submitted by Client: All ad copy submitted must be original copy. Pre-written affiliate copy will not be accepted. All copy must be written in article format, containing informational content. Sales letters will not be permitted.

In no way can AdsOnQ™ nor any of our partners be held liable for the success or outcome of your advertisements. The success of your advertising campaign depends solely on you, the information you submit and/or your offers. We cannot guarantee sales, or specific search engine ranking, as we do not control how the search engines do their business, and we do not control how the general population spends their money.

You agree to place AdsOnQ™ syndication code on a web site that you own. Removal of the syndication code from your site will result in the termination of your ad.

Your ad copy must meet the advertsing guidelines of the US Federal Trade Commission as well as pass review by our copy editors. There is a $50 non-refundable fee for submitting your ad. Once your ad has passed review, you will receive a bill for the balance to your PayPal address. The balance must be paid prior to the activation of your ad.

Due to their nature and high cost value, refunds cannot be issued once your advertisment has been syndicated to the channel feed. This is the reason for our Quality Guarantee.

You understand that we do not tolerate the abuse of our participating publishers in any way. We ask that you please refrain from this type of activity.

In no event will AdsOnQ™ or any of our partners be liable to you for damages of any kind, including but not limited to, compensatory damages, lost profits, lost data or any form of special, incidental, indirect, consequential or punitive damages of any kind whether based on breach of contract or warranty, tort (including negligence), product liability or otherwise, even if AdsOnQ™ is informed in advance of the possibility of such damages.

Any violators of thes terms will have their ad campaign immediately removed and will be permanently banned from future use of our ad services.

You also understand that this is a legally binding agreement between you, the purchaser and the purchasee, AdsOnQ™.

Limitation of liability

AdsOnQ™ will not be liable for any damages or injury that accompany or result from your use of any of its site. These include (but are not limited to) damages or injury caused by any:

Use of (or inability to use) the site
Use of (or inability to use) any site to which you hyperlink from our site
Failure of our site to perform in the manner you expected or desired
Error on our site
Omission on our site
Interruption of availability of our site
Defect on our site
Delay in operation or transmission of our site
Computer virus or line failure

Upon termination, you must destroy all materials. In addition, by providing material on our Web site, we do not in any way promise that the materials will remain available to you. And AdsOnQ™ is entitled to terminate all or any part of any of its web site without notice to you.

Jurisdiction and Other Points to Consider

If you use our site from locations outside of the United States, you are responsible for compliance with any applicable local laws.

AdsOnQ™, and you consent to exclusive jurisdiction and venue in such courts.

Any other disputes will be resolved as follows:

If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Montrose County. CO. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each party.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Montrose County. CO, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.

AdsOnQ™ may modify these Terms of Service, and the agreement they create, at any time, simply by updating this posting and without notice to you. This is the ENTIRE agreement regarding all the matters that have been discussed above.
